The Spa and Wellness Industry booms and grows every day and as we see many corporate houses are entering this business. According to a recent research, The Spa services market would reach $154.6 billion by 2022. If you are a budding entrepreneur looking for an opportunity to explore your entrepreneurial skills, opening a spa salon could turn out to be quite lucrative. Currently, there is hardly any regulation of this industry in India.  But like any business, you’ll need to have a few legal documents before you’re open for business. These are following documents that are required to start a day spa business in India.

In India when you start any business with physical shop then it’s required the shop act license from your state body. The Shop and Establishment Act is called as Gumasta in the regional language in Maharashtra. Shop and Establishment license is a must if you have a physical shop or an office where the business is done. All the shops have to be registered under this act. It gives you a legal permission to do a business in that shop and also a proof of a particular business being done at that place. Various benefits and tax subsidies can also be availed if you have Shop & Establishment License.

Various documents are required to obtain a Shop & Establishment License:

-Aadhar card

-Proof of establishment – any lease deed, Electricity / Telephone bills, etc.

-PAN card of the proprietor

– Address proof of proprietor

-Authority Letter for Business

– Details of employees / Manager of the establishment

-Form-A which is an application for Registration within 30 days of starting any work to the inspector of the area.

GST is the biggest tax reform in India, tremendously improving ease of doing business and increasing the taxpayer base in India by bringing in millions of small businesses in India. If you want to start a spa business, you must register for GST. Under the new GST regime, if you run a business or other enterprise which is involved in buying or selling goods or providing services or both are required to register for GST. Without GST registration you would not be allowed to collect GST from your customers or claim input tax credit of GST paid. You could also be penalised.

You will require the following documents to register for GST:

-PAN Card of the Business or Applicant

-Identity and Address Proof along with Photographs

-Business Registration Document

-Address Proof for Place of Business

-Bank Account Proof

-Digital Signature

Sales Tax Registration is mandatory for any business entity engaged in the sale of goods in India.  If you intend to Retail Spa products from your Spa, such as shampoo, conditioner, oils etc. It’s important to take a VAT/ Sales tax registration, otherwise there is no requirement. Documents required for VAT & sales tax registration are:

-PAN Card copy of firm/Company

-Copy of Property papers

-Rent agreement copy (If rented property)

-MOA/AOA (In case of company)

-Certificate of incorporation (In case of company)

-Copy of Partnership Deed (In case of Partnership)

-Certificate of incorporation (In case of company)

-Electricity/Water/Telephone bill of business place

 

These were the major Licensing/certification required for starting a spa business. Apart from these, the following legal documents are also required:

-Income tax return file
